Expressing serious concern over high pollution levels in Delhi during Diwali festival, the Supreme Court took exception to the violation of court orders and said its directives on firecrackers ban were "hardly implemented". A bench of Justices Abhay S Oka and Augustine George Masih referred to newspaper reports mentioning a considerable violation of court orders and sought the Delhi government's response on "perpetual ban" on firecrackers in the national capital. The top court asked the Delhi government and the police on the steps that were taken to implement the orders completely banning manufacture, sale and bursting of firecrackers in the national capital and the action they have taken against the violators. "We want the Delhi government to immediately respond as to why this has happened. We want all the orders to be placed on record banning the sale, manufacture and bursting of firecrackers in Delhi. We are also issuing notice to the Delhi police commissioner on the action police has taken so far against the violators and the steps it is taking to implement the orders of the court," the bench said. It directed the Delhi government and police commissioner to file their responses within a week saying, "there cannot be any dispute that the orders of the court banning firecrackers were hardly implemented". "Firecracker bursting was the major cause of pollution during Diwali and if the orders of the court are not implemented, it will be a chaotic situation," the bench told Additional Solicitor General Archana Pathak Dave, appearing for the Centre, and the counsel for Delhi government. It posted the matter for further hearing on November 14 for compliance of its directions.

दिल्ली में दीपावली के बाद वायु प्रदूषण के खतरनाक स्तर पर पहुंच गया है. सुप्रीम कोर्ट ने सोमवार को इस संबंध में दिल्ली सरकार और अन्य अधिकारियों से राष्ट्रीय राजधानी में पटाखों के इस्तेमाल पर स्थायी प्रतिबंध के मुद्दे पर फैसला लेने को कहा. शीर्ष अदालत ने दिल्ली में पटाखों पर प्रतिबंध लागू न किए जाने पर कड़ी आलोचना की और दिल्ली सरकार तथा दिल्ली के पुलिस आयुक्त को निर्देश दिया कि वे एक सप्ताह के भीतर हलफनामा दाखिल कर इस साल प्रतिबंध लागू करने के लिए उठाए गए कदमों के साथ-साथ अगले साल प्रतिबंध का अनुपालन सुनिश्चित करने के लिए उठाए गए कदमों के बारे में भी बताएं. शीर्ष अदालत ने कहा कि यह स्पष्ट है कि पटाखों पर प्रतिबंध के संबंध में उसके आदेश का पालन नहीं किया गया और दिवाली के आसपास पराली जलाने की घटनाएं भी बढ़ गईं. दिल्ली के कई इलाकों में हवा की गुणवत्ता गंभीर स्तर को पार कर गई क्योंकि पीएम 2.5 की मात्रा बढ़ गई, जिससे सांस संबंधी खतरनाक स्थिति पैदा हो गई है. पीएम 2.5 स्तर 2022 की तुलना में 34 प्रतिशत अधिक जस्टिस अभय ओका और जस्टिस ऑगस्टीन जॉर्ज मसीह की पीठ ने सोमवार को कहा कि दिल्ली में पटाखों पर प्रतिबंध लागू न किए जाने का असर सीएसई की रिपोर्ट से बहुत स्पष्ट है. सेंटर फॉर साइंस एंड एनवायरनमेंट (सीएसई) द्वारा शनिवार को जारी एक रिपोर्ट के अनुसार, इस साल दिवाली की आधी रात को पार्टिकुलेट मैटर (पीएम) 2.5 का अधिकतम सांद्रता स्तर 2022 और 2023 की तुलना में 13 प्रतिशत अधिक था. सीएसई ने यह भी पाया कि इस साल दिवाली पर पीएम 2.5 का स्तर 2022 में त्योहार की रात की तुलना में 34 प्रतिशत अधिक था. पीठ ने कहा कि रिपोर्ट से पता चलता है कि इस दिवाली पर प्रदूषण का स्तर अब तक के उच्चतम स्तर पर था और यह 2022 और 2023 की दिवाली से कहीं अधिक था. जस्टिस ओका ने आदेश सुनाते हुए कहा, "इसके अलावा, रिपोर्ट से संकेत मिलता है कि दिवाली के दिनों में खेतों में पराली जलाने की घटनाएं बढ़ जाती हैं. हम दिल्ली सरकार को निर्देश देते हैं कि वह पटाखों के इस्तेमाल पर प्रतिबंध लगाने के आदेशों और इसे लागू करने के लिए दिल्ली सरकार द्वारा उठाए गए कदमों को रिकॉर्ड में रखते हुए विस्तृत हलफनामा दाखिल करे." जस्टिस ओका ने कहा, "हम दिल्ली के पुलिस आयुक्त को नोटिस जारी करते हैं, जिसमें उनसे दिल्ली में पटाखों के जलाने पर पूर्ण प्रतिबंध लागू करने के लिए पुलिस द्वारा उठाए गए कदमों को दर्शाने वाला हलफनामा दाखिल करने को कहा जाता है." शीर्ष अदालत ने कहा कि हलफनामा दाखिल करते समय दिल्ली सरकार और पुलिस को यह बताना होगा कि पटाखों के जलाने पर प्रतिबंध को पूरी तरह लागू करने के लिए वे अगले साल क्या प्रभावी कदम उठाने का प्रस्ताव रखते हैं और लोगों में जागरूकता लाने के लिए क्या उपाय किए गए हैं. पीठ ने कहा, "हम हरियाणा और पंजाब की सरकारों को अक्टूबर के आखिरी 10 दिनों के दौरान पराली जलाने की घटनाओं की संख्या का ब्योरा देते हुए हलफनामा दाखिल करने का भी निर्देश देते हैं." पीठ ने मामले में अगली सुनवाई 14 नवंबर को निर्धारित की है और कहा है कि दिल्ली पुलिस और सरकार को आज से एक सप्ताह के भीतर हलफनामा दाखिल करना चाहिए. दिल्ली में खेतों में पराली जलाने पर भी मांगी रिपोर्ट दिल्ली सरकार हलफनामा दाखिल करते समय यह भी बताएगी कि क्या दिल्ली में खेतों में पराली जलाने की घटनाएं हुई हैं. एक वकील ने दलील दी कि यह प्रतिबंध केवल दिवाली पर ही नहीं होना चाहिए, बल्कि इसे अगले कुछ महीनों में आने वाले शादियों के मौसम के दौरान भी बढ़ाया जाना चाहिए. पीठ ने कहा, "हम ऐसा ही करने का प्रस्ताव रखते हैं, लेकिन हम सिर्फ यह देखना चाहते हैं कि पारित आदेश पर क्या अमल हुआ है. हम ऐसा करने का प्रस्ताव रखते हैं. अन्य त्योहार भी हैं...शादियां, चुनाव." जस्टिस ओका ने कहा, "इस बीच, दिल्ली सरकार और अन्य अधिकारी दिल्ली में पटाखों के जलाने पर स्थायी प्रतिबंध के मुद्दे पर भी निर्णय लेंगे." दिल्ली एनसीआर में पटाखों पर प्रतिबंध लागू नहीं किया गया... सुनवाई के दौरान, सुप्रीम कोर्ट ने कहा, "ऐसी कई खबरें हैं कि दिल्ली एनसीआर में पटाखों पर प्रतिबंध बिल्कुल भी लागू नहीं किया गया, जबकि यह प्रदूषण कम करने के लिए महत्वपूर्ण उपाय माना जाता है." पटाखों पर प्रतिबंध लगाने के लिए एक तंत्र विकसित करने की आवश्यकता पर जोर देते हुए पीठ ने पूछा कि पटाखों पर प्रतिबंध लगाने का आदेश क्या है और इसे कैसे लागू किया जा रहा है. पीठ ने दिल्ली सरकार से कहा, "कुछ काम किया जाना चाहिए" और उसे 2025 में वायु प्रदूषण को रोकने के लिए "कम से कम अगले साल के लिए" एक तंत्र विकसित करने के लिए कहा. सुप्रीम कोर्ट दिल्ली में वायु प्रदूषण से जुड़े एक मामले में सुनवाई कर रहा था.

उच्चतम न्यायालय ने दिवाली पर राष्ट्रीय राजधानी में प्रदूषण के स्तर में जबरदस्त वृद्धि पर सोमवार को गंभीर चिंता जताई और अदालती आदेशों के उल्लंघन का संज्ञान लेते हुए कहा कि पटाखों पर प्रतिबंध से जुड़े उसके निर्देशों पर “शायद ही अमल हुआ।” न्यायालय ने दिल्ली सरकार और पुलिस आयुक्त से यह बताने को कहा कि राष्ट्रीय राजधानी में पटाखों के निर्माण, ब्रिकी और उन्हें फोड़ने पर पूर्ण प्रतिबंध संबंधी आदेशों को लागू करने के लिए क्या कदम उठाए गए और उल्लंघनकर्ताओं के खिलाफ क्या कार्रवाई की गई। न्यायमूर्ति अभय एस ओका और न्यायमूर्ति ऑगस्टीन जॉर्ज मसीह की पीठ ने अखबारों में प्रकाशित उन खबरों का हवाला दिया, जिनमें पटाखों पर प्रतिबंध से जुड़े अदालती आदेशों के उल्लंघन का जिक्र किया गया है। पीठ ने दिल्ली सरकार को राष्ट्रीय राजधानी में पटाखों पर “स्थायी प्रतिबंध” लगाने के मुद्दे पर अपना जवाब दाखिल करने का निर्देश दिया। पीठ ने कहा, “हम चाहते हैं कि दिल्ली सरकार तुरंत जवाब दे कि ऐसा क्यों हुआ। हम चाहते हैं कि दिल्ली में पटाखों की बिक्री, निर्माण और उन्हें फोड़ने पर प्रतिबंध लगाने से जुड़े सभी आदेश रिकॉर्ड पर रखे जाएं।” उसने कहा, “हम दिल्ली पुलिस आयुक्त को भी नोटिस जारी कर यह बताने को कह रहे हैं कि पुलिस ने उल्लंघनकर्ताओं के खिलाफ क्या कार्रवाई की और वह अदालती आदेशों को लागू करने के लिए क्या कदम उठा रही है।” शीर्ष अदालत ने दिल्ली सरकार और दिल्ली पुलिस आयुक्त को अपने जवाब दाखिल करने के लिए एक हफ्ते का समय दिया। उसने कहा, “इस बात पर कोई विवाद नहीं हो सकता कि पटाखों पर प्रतिबंध के न्यायालय के आदेश का शायद ही पालन किया गया।” पीठ ने केंद्र की तरफ से पेश अतिरिक्त सॉलिसिटर जनरल अर्चना पाठक दवे और दिल्ली सरकार के वकील से कहा, “दिवाली के दौरान प्रदूषण का मुख्य कारण पटाखे फोड़ना था और अगर अदालत के आदेशों पर अमल नहीं किया जाएगा, तो अराजक स्थिति पैदा होगी।” पीठ ने मामले की अगली सुनवाई के लिए 14 नवंबर की तारीख तय की। मामले में न्यायमित्र नियुक्त की गई वरिष्ठ अधिवक्ता अपराजिता सिंह ने कहा कि अदालत के आदेशों का बेधड़क उल्लंघन किया गया। उन्होंने सर्वोच्च न्यायालय के समक्ष ‘सेंटर फॉर साइंस एंड एनवायरमेंट (सीएसई)’ की एक रिपोर्ट पेश की, जिसमें कहा गया है कि दिवाली पर प्रदूषण का स्तर एक दिन पहले की तुलना में लगभग 30 फीसदी बढ़ गया। सीएसई की रिपोर्ट का हवाला देते हुए शीर्ष अदालत ने कहा कि आंकड़ों से स्पष्ट है कि 2024 में दिवाली 2022 और 2023 के मुकाबले अधिक गर्म थी और इस दौरान प्रदूषण का स्तर भी ज्यादा था। दिवाली से पहले लोगों के बीच जागरूकता फैलाने की आवश्यकता पर जोर देते हुए पीठ ने कहा कि जाहिर है कि जब पटाखों की बिक्री पर प्रतिबंध होगा, तो लोग दूसरे राज्यों से इन्हें मंगाने की कोशिश करेंगे। उसने कहा, “दिल्ली में पटाखों पर प्रतिबंध का उल्लंघन करने वालों के खिलाफ उनके परिसरों को सील करने जैसी सख्त कार्रवाई किए जाने की जरूरत है।”

Peak Diwali pollution in Delhi 13% higher than last year: CSE report

The peak concentration level of particulate matter (PM) 2.5 was 13% higher at midnight on Diwali this year compared to 2022 and 2023, according to a report released by the Centre for Science and Environment (CSE) on Saturday. It also found that PM2.5 levels were 34% higher on Diwali this year than on the night of the festival in 2022, which was also an end-of-October celebration. North-westerly winds prevailed during the day on October 31, amplifying the impact of stubble burning on Delhi’s air quality,” the report said. The city’s air quality turned from ‘poor’ to ‘very poor’ even when the share of smoke from farm fires was less than 3%, indicating the impact of local air pollution sources. As for vehicular pollution, the report stated that ITO had the highest NO2 levels. “Diwali night this year had higher NO2 levels compared with last year’s Diwali night. NO2 levels in the last three years have been higher on Diwali night and also the nights preceding it, which is indicative of congestion and high traffic conditions in the city leading to the festival night. ITO had the highest NO2 levels in the city with a night-time average of 182 microgram per cubic metre. JLN Stadium and Patparganj, with 104 and 101 micrograms per cubic metre were the other NO2 hotspots on Diwali night. Lodhi Road, with just 2 microgram per cubic metre of NO2, was the least affected area in the city,” the report said, while warning that the upcoming cold and calm weather might intensify the pollution status.
