The Supreme Court on Monday heard the matter relating to Delhi air pollutionamid rising concerns over deteriorating air quality in the national capital. The top court noted that reports in newspapers said that the ban on firecrackers was not implemented. "This is responsible for sudden deterioration In air quality," the court said. "What is the purpose of our order?" the bench asked. The courts said that there was a ban on the use of firecrackers in Delhi-NCR and it has been violated. "Pollution is higher than 2022, 2023...Apparently, people were bringing crackers from other states," the court added. 'We Need Immediate Answers' The Supreme Court has issued a notice to Delhi police commissioner and the government asking what steps they took to implement the firecracker band order. "We will issue notice to Delhi police commissioner, will ask if SC order was implemented," it added. "It not be repeated next year. The court said, "We need immediate answers...this should not happen next year." The apex court noted that there are two issues to consider. "Amicus Curiae has relied upon the reports by the Centre for Science and Environment to highlight the statistics. Delhi government's counsel stated that there was a ban on the use of crackers. There cannot be in dispute that the ban was hardly implemented," the court noted. It said that the effect of non-implementation of the ban is evident from the report which says pollution level this Diwali was all time high. "Higher than Diwali of 2022 and 2023. Moreover, report indicates that farm fires were on the rise. We direct Delhi government to file detailed affidavit placing on record order banning crackers and steps taken" the court added, The bench said the affidavit must indicate what steps they propose to take next year to ensure the ban on firecrackers is fully implemented. SC to Punjab and Haryana The Supreme Court told the lawyer for the Union of India to decide Punjab's proposal for the release of funds (for providing tractors with drivers etc to small farmers). "You cannot keep it pending. Specific direction was issued to decide within two weeks. Time to take decision extended by one week. Compliance is to be reported by 14th November," the bench said. It added that they must also decide on funds to provide alternative mechanism to farmers to remove stubble. The apex court ordered Punjab and Haryana to file affidavits indicating instances of stubble-burning and farm firesin the last 10 days. ‘What steps taken’: SC issues notice to Delhi government, police over firecrackers ban

On Monday morning, the air quality in Delhi dropped significantly, reaching 'severe' levels four days after Diwali. Many neighbourhoods, including Anand Vihar, Rohini, Ashok Vihar, and Vivek Vihar, reported AQI readings above 400 on a scale of 500. Even wealthier areas like Lodi Road were affected by the pollution. As of 7 AM, the 24-hour average AQI was 373, which was nearly as high as Sunday’s season-worst reading of 382. This decline in air quality occurred despite a 15% decrease in pollution from farm fires, highlighting the ongoing issue. The air quality situation in the NCR region is still a concern. Noida recorded an AQI of 305, Ghaziabad at 295, and Gurugram at 276. Nearby states also experienced high AQI levels, with Hisar in Haryana at (372) and Sriganganagar (397) and Bharatpur (320) in Rajasthan. On the night after Diwali (November 2), PM2.5 levels in Delhi reached a hazardous level of 603 micrograms per cubic meter, which is 13% higher than the previous two years. The night of Diwali also saw increased levels of nitrogen dioxide, according to the Centre for Science and Environment. PM2.5 refers to tiny particles in the air that are 2.5 micrometres in diameter or smaller, and they can be harmful to health. The acceptable annual limit for these particles is 40 micrograms per cubic metre. Recently, the Supreme Court directed the governments of Punjab and Haryana to provide affidavits that detail incidents of farm fires and agricultural waste burning that occurred between October 22 and 31, as these activities release pollutants into the air. A bench of Justices Abhay S Oka and Augustine George Masih referred to newspaper reports mentioning a considerable violation of court orders and sought the Delhi government's response on "perpetual ban" on firecrackers in the national capital. The top court asked the Delhi government and the police on the steps that were taken to implement the orders completely banning manufacture, sale and bursting of firecrackers in the national capital and the action they have taken against the violators. "We want the Delhi government to immediately respond as to why this has happened. We want all the orders to be placed on record banning the sale, manufacture and bursting of firecrackers in Delhi. We are also issuing notice to the Delhi police commissioner on the action police has taken so far against the violators and the steps it is taking to implement the orders of the court," the bench said. It directed the Delhi government and police commissioner to file their responses within a week saying, "there cannot be any dispute that the orders of the court banning firecrackers were hardly implemented". "Firecracker bursting was the major cause of pollution during Diwali and if the orders of the court are not implemented, it will be a chaotic situation," the bench told Additional Solicitor General Archana Pathak Dave, appearing for the Centre, and the counsel for Delhi government. It posted the matter for further hearing on November 14 for compliance of its directions.

Peak Diwali pollution in Delhi 13% higher than last year: CSE report

The peak concentration level of particulate matter (PM) 2.5 was 13% higher at midnight on Diwali this year compared to 2022 and 2023, according to a report released by the Centre for Science and Environment (CSE) on Saturday. It also found that PM2.5 levels were 34% higher on Diwali this year than on the night of the festival in 2022, which was also an end-of-October celebration. The report’s findings corroborate the anecdotal evidence that suggests that the ban on firecrackers was violated in equal, if not larger, measures this year compared to the recent past, taking a heavy environmental toll on the city’s residents. Punjab ac counted for the highest share at 80%, followed by Uttar Pradesh at 13% and Haryana at 7%. North-westerly winds prevailed during the day on October 31, amplifying the impact of stubble burning on Delhi’s air quality,” the report said. The city’s air quality turned from ‘poor’ to ‘very poor’ even when the share of smoke from farm fires was less than 3%, indicating the impact of local air pollution sources. As for vehicular pollution, the report stated that ITO had the highest NO2 levels. “Diwali night this year had higher NO2 levels compared with last year’s Diwali night. NO2 levels in the last three years have been higher on Diwali night and also the nights preceding it, which is indicative of congestion and high traffic conditions in the city leading to the festival night. ITO had the highest NO2 levels in the city with a night-time average of 182 microgram per cubic metre. JLN Stadium and Patparganj, with 104 and 101 micrograms per cubic metre were the other NO2 hotspots on Diwali night. Lodhi Road, with just 2 microgram per cubic metre of NO2, was the least affected area in the city,” the report said, while warning that the upcoming cold and calm weather might intensify the pollution status.
